The Public Sector (Data Sharing) Act 2016 provides a framework for the sharing of information by State Government agencies.

This Act is administered by the Office for Data Analytics.

Information Sharing Guidelines

The Information Sharing Guidelines are designed to give providers of services to children, young people and adults, confidence in sharing information when required to prevent harm or respond to current threats to safety and wellbeing.

Information Privacy Principles Exemptions

If an agency needs to share information but it is outside of the Public Sector (Data Sharing) Act 2016, Information Sharing Guidelines and the sharing may breach the Information Privacy Principles Instruction an application can be made to the Privacy Committee for an exemption from relevant principles.

Formal request for an exemption to the Information Privacy Principles Instruction can be made using the Information Privacy Principles Exemption Template.  This will enable the exemption to progress through to the Privacy Committee for approval.

Agencies are encouraged to contact the Privacy Committee's Executive Officer before preparing their paperwork to discuss the exemption process.

Extensions to approved exemptions may also be sought.
