The first Privacy Committee of South Australia was appointed in December 1983 in response to a South Australian Law Reform Committee Report recommending the adoption of emerging developments in data protection.
In 1988, the same year as the enactment of the Commonwealth Privacy Act, 1988, Cabinet approved the form and content of the Cabinet Administrative Instruction 1/89 - Information Privacy Principles (IPPs). The Information Privacy Principles were based on the organisation for Economic and Development 1980 Guidelines Governing the Protection of Privacy and Trans-border Flows of Personal Data, which established the basis for many of the world's data protection regimes.
Cabinet also approved the establishment of an ongoing Privacy Committee, which was appointed in July 1989. The Privacy Committee of South Australia was proclaimed in 2001 to oversee the implementation of the Information Privacy Principles against personal information in the custody of the South Australian Public Sector and to provide advice on privacy issues. Documentation on the Privacy Committee may be found as an addendum to the instruction circular Information Privacy Principles (IPPs).
The connection between the Privacy Committee and State Records is particularly strong because of the importance of information management. It is because of this connection that State Records provides executive support to the Privacy Committee. South Australian State Government Agencies may correspond with or make enquiries of the Privacy Committee via the Executive Officer, Privacy Committee of South Australia. The Privacy Committee is composed of six members appointed by the Minister for Finance. In November 2004, the Minister appointed a new sitting of the Privacy Committee of South Australia.
Terry Ryan the Presiding Member, was chosen by the Minister for his expertise in information and records management. Mr Ryan is the Director of State Records, Department of the Premier and Cabinet.
Nancy Rogers was appointed on the nomination of the Commissioner for Public Employment. Ms Rogers is Manager, Research and Analysis within the Department for Families and Communities and has extensive knowledge in the management of personal information in the families and communities sector.
Andrew Stanley was appointed on the nomination of the Minister for Health. Mr Stanley is the Director of the Strategic Planning and Research Branch, Strategic Planning and Population Health Division, Department of Health and has extensive knowledge of the management of personal information in the field of health.
Samantha Doherty was chosen by the Minister and is not a public sector employee (within the meaning of the Public Sector Management Act 1995). Ms Doherty has had several years' experience in law enforcement, with some time also spent working within the local government sector. She therefore brings to the role practical knowledge in two areas where handling personal information is of particular significance.
Bernadette Quirke is a Solicitor, Crown Solicitor's Office, Attorney-General's Department. Ms Quirke is a person appointed on the nomination of the Attorney-General. She has been involved with the application of the South Australia Public Sector's privacy requirements in contractual arrangements with the private sector.
Christopher Radbone is Principal Consultant, Governance, in the Information Science and Technology Directorate of the Department for Environment and Heritage. Mr Radbone was appointed by the Minister for his expertise in information technology. He has a broad range of experience across the South Australian Government and in the private sector, particularly in across government information technology initiatives.
